To work out if SPCC rule applies to your facility there are a number of questions that will help you determine if that is the case of not. Here’s a short guide that can be used.

Ask yourself these 5 Questions:

  1. Is your facility or part of your facility (e.g. complex) considered non-transportation-related?If the Answer is No -the your facility is not subject to SPCC rule.
  2. Is your facility engaged in drilling, producing, gathering, storing, processing, refining, transferring, distributing, using or consuming oil?If the Answer is No -the your facility is not subject to SPCC rule.
  3. Could your facility reasonably be expected to discharge oil in quantities that may be harmful into navigable waters or adjoining shorelines?If the Answer is No -the your facility is not subject to SPCC rule.
  4. Is the total aggregate capacity of aboveground oil storage containers greater than 1,320 gallons of oil?

If the Answer is No -the your facility is not subject to SPCC rule.

  1. Is the total aggregate capacity of completely buried storage tanks greater than 42,000 gallons of oil? – In answering this question you should not include completely buried tanks subject to all technical requirements of 40 CFR 280/281, or any containers that are less than 55 gallons. Containers that are permanently closed or storage containers used exclusively for wastewater treatment should also be excluded from the calculation)Yes – Your facility is subject to the SPCC rule.
